1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use Tempo. By using the Services, you represent that you meet this requirement.

2. Health & Medical Disclaimer

Tempo provides fitness, wellness, and educational content only. Tempo is not a medical provider and does not provide medical advice, diagnosis, or treatment.

Always consult a qualified healthcare professional before beginning or changing any exercise, nutrition, or wellness program, especially if you are pregnant, postpartum, have a medical condition, or are taking medication.

If you experience pain, dizziness, shortness of breath, or other concerning symptoms, stop activity and seek medical care.

3. Your Account

You may need an account to access certain features.

You agree to:

• Provide accurate information
• Keep your login credentials secure
• Be responsible for all activity under your account

You must notify us promptly of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

• Use the Services for unlawful purposes
• Interfere with or disrupt the Services
• Attempt to access systems or data without authorization
• Reverse engineer, scrape, or copy the Services except as permitted by law
• Upload malicious code or harmful content

We may suspend or terminate access for violations.

5. Subscriptions, Billing, and Auto-Renewal

If you purchase a paid plan:

• You authorize us (or our payment processor) to charge applicable fees and taxes
• Subscriptions may auto-renew unless canceled before renewal
• Pricing and plan features may change with notice where required

Unless required by law, fees are non-refundable. If a platform (e.g., Apple/Google) processes your purchase, their billing/refund terms also apply.

6. Free Trials and Promotions

We may offer free trials or promotional access. If not canceled before trial end, your subscription may convert to a paid plan under disclosed terms.

We may modify or end promotions at any time, subject to applicable law.

7. User Content

If you submit content (e.g., check-ins, feedback, messages), you retain your rights in that content.

You grant Tempo a non-exclusive, worldwide, royalty-free license to host, process, and use your content solely to operate, improve, and provide the Services.

You represent that you have rights to any content you submit and that it does not violate law or third-party rights.

8. Intellectual Property

Tempo and its content, software, branding, logos, and design are owned by Tempo or its licensors and are protected by intellectual property laws.

Except for limited personal use of the Services, you may not copy, modify, distribute, sell, or create derivative works without written permission.

9. Third-Party Services

Tempo may integrate with third-party services (e.g., Apple Health, analytics, payment processors). Your use of those services is governed by their terms and policies, and we are not responsible for their actions.

10. Privacy

Your use of Tempo is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information.

11. Service Availability and Changes

We may update, modify, suspend, or discontinue any part of the Services at any time. We do not guarantee uninterrupted or error-free operation.

12. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, Tempo and its affiliates, officers, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from or related to your use of the Services.

Our total liability for claims relating to the Services will not exceed the amount you paid to Tempo in the 12 months before the event giving rise to liability (or USD $100 if you have not paid).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless Tempo and its affiliates from claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.

15. Termination

You may stop using the Services at any time.

We may suspend or terminate your access at any time if you violate these Terms or if needed to protect the Services, users, or legal compliance.

Sections that by nature should survive termination will survive (e.g., IP, disclaimers, limitations, indemnity, dispute provisions).

16. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles, unless otherwise required by applicable consumer law.

17. Dispute Resolution

Before filing a formal claim, you agree to contact us first at sdhines3@gmail.com so we can attempt to resolve the issue informally.

If a dispute cannot be resolved informally, it will be resolved in the state or federal courts located in California, unless otherwise required by law.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and provide notice where required. Continued use after changes means you accept the revised Terms.
